Post-decision Phase Activities — Compliance and Enforcement
The purpose of compliance and enforcement is to:
- Promote, educate, verify, and facilitate compliance with the IAA and the conditions set out in the Decision Statement
- Undertake compliance activities and enforcement actions to prevent, identify or correct non-compliance and adverse effects
- Promote a consistent and transparent approach to compliance with, and enforcement of, the IAA
There are provisions to verify compliance, issue orders, and correct non-compliance. For example, the Agency will:
- Carry out inspections in relation to designated projects to verify compliance or prevent non-compliance
- Coordinate inspections and investigations with other jurisdictions
- Take enforcement actions as required
- Investigate suspected contraventions
- Undertake measures to compel compliance through court action, such as injunctions and prosecutions.
