Timing

The timeline for when the Minister must issue the Decision Statement varies according to who is making the determination:

  • When the Minister of Environment and Climate Change makes the public interest determination, the Minister must issue the Decision Statement no later than 30 days from the time the Impact Assessment Report, or a summary of that report, is posted on the Registry.
  • When the Governor in Council makes the public interest determination, the Minister must issue the Decision Statement no later than 90 days from the time
    • the Impact Assessment Report, or a summary of that report, is posted on the Registry for impact assessments by the Agency, or
    • the Agency’s recommendations to assist the Minister in establishing conditions are posted for impact assessments by review panel.
